Acceptance of Terms
These Terms & Conditions govern access to and use of TranscendTech, including our website, AI-powered client acquisition platform, booking flows, CRM features, analytics, email automation, SMS notifications, and related services.
By accessing or using TranscendTech, submitting information, booking an appointment, receiving communications, or managing an authenticated business account, you agree to these Terms. If you do not agree, do not use the services.
Services Provided
TranscendTech provides tools for service-based businesses to capture leads, qualify inquiries, schedule appointments, manage CRM records, send email and SMS notifications, connect calendars, view analytics, and manage organization-specific settings.
Some services may be configured for a specific business, organization, campaign, or website. Features may change over time as we improve the platform.
User Responsibilities
Users are responsible for providing accurate information, maintaining the confidentiality of account credentials, using the platform lawfully, and ensuring they have authority to submit or manage information on behalf of a business or organization.
Business users are responsible for the accuracy of their organization settings, booking availability, communication preferences, customer data, and any content or instructions they provide for use in the platform.
AI Assistant Disclaimer
The TranscendTech AI assistant is designed to help with project intake, lead qualification, routing, and general service guidance. AI-generated responses may be incomplete, inaccurate, or not appropriate for every situation.
The AI assistant does not provide legal, financial, medical, or other professional advice. Users should review important information independently and contact the relevant business or TranscendTech team when human confirmation is needed.
Appointment Scheduling
Visitors may use TranscendTech to request or schedule appointments with a business. Appointment availability, duration, timezone, meeting location, cancellation handling, and follow-up are controlled by the relevant business and its organization settings.
A booking confirmation means the appointment has been recorded in the platform. Calendar event creation, Google Meet links, or other meeting links may depend on third-party integrations and business configuration.
Communications
By submitting forms, booking appointments, or using the platform, users may receive transactional communications related to inquiries, appointments, customer support, account activity, lead management, meeting links, reminders, or service updates.
Communications may be sent by email, SMS, phone, calendar invitations, or other channels based on user consent, business configuration, and applicable law.
SMS Terms
Users who explicitly opt in to SMS messages may receive text messages related to lead inquiries, booking confirmations, scheduling updates, appointment reminders, relevant customer-care follow-ups, no-show recovery, cancellations, meeting updates, or support.
Message frequency varies. Message and data rates may apply. Users may reply STOP to unsubscribe from SMS messages and HELP for assistance.
SMS consent is optional and is not a condition of purchase. Users may submit inquiries and book appointments without opting in to SMS messages.
SMS consent is not shared, sold, rented, or provided to third parties or affiliates for marketing purposes. SMS delivery may be provided through Twilio or another configured messaging provider.
Intellectual Property
TranscendTech, including its software, workflows, designs, platform architecture, branding, content, and related materials, is owned by TranscendTech or its licensors and is protected by intellectual property laws.
Users may not copy, modify, reverse engineer, resell, or exploit the platform except as expressly permitted in a written agreement or by applicable law.
Acceptable Use
Users may not use TranscendTech to send unlawful, abusive, deceptive, harassing, infringing, spam, or malicious content. Users may not interfere with platform security, attempt unauthorized access, misuse APIs, upload harmful code, or violate communication laws.
Business users are responsible for ensuring their use of email, SMS, AI, analytics, booking, and CRM features complies with applicable laws, consent requirements, and industry rules.
Limitation of Liability
To the maximum extent permitted by law, TranscendTech will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, loss of goodwill, business interruption, or third-party service failures.
TranscendTech's total liability for claims related to the services will be limited to the amount paid to TranscendTech for the services giving rise to the claim during the three months before the claim arose, or one hundred dollars if no paid services apply.
Disclaimer of Warranties
The services are provided on an as-is and as-available basis. TranscendTech does not warrant that the services will be uninterrupted, error-free, secure, or that AI outputs, lead scoring, booking availability, email delivery, SMS delivery, calendar integrations, or analytics will always be accurate or available.
Third-party services such as hosting providers, databases, Google Calendar, Resend, Twilio, analytics providers, and AI infrastructure may affect platform availability and functionality.
Indemnification
Users and business customers agree to defend, indemnify, and hold harmless TranscendTech from claims, damages, liabilities, costs, and expenses arising from their use of the services, violation of these Terms, unlawful communications, inaccurate data, misuse of customer information, or infringement of third-party rights.
Termination
We may suspend or terminate access to TranscendTech if a user violates these Terms, creates risk for the platform or others, fails to pay applicable fees, misuses communications features, or uses the services unlawfully.
Users may stop using public-facing services at any time. Business account termination, data export, and deletion may be governed by a separate agreement or operational process.
Governing Law
These Terms are governed by the laws of the United States and the state where TranscendTech is legally organized, without regard to conflict of law principles. Any disputes will be handled in the applicable courts unless a separate written agreement provides otherwise.
Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised last updated date. Continued use of TranscendTech after changes become effective means the updated Terms apply.
